In short:
  • We only ask for what we need to help you.
  • We do not sell your data or hand it over for advertising.
  • This site uses no advertising or tracking cookies.
  • You can ask us to show, correct or delete your data at any time by writing to hola@smartcrece.com.

1. Who is responsible

SmartCrece is a business of Yerandi Reyes Fajardo, its founder, who runs it as an individual (sole proprietor) from Houston, Texas, United States. In this policy, "SmartCrece," "we," "us" and "our" refer to him and to this business.

This policy covers smartcrece.com, its forms and chat, our phone and WhatsApp numbers, the SmartCrece Community, and the emails we send.

2. What we collect and why

Contact and assessment form

Your name, your business name, your email, your phone or WhatsApp (optional), what you are interested in, and anything you tell us. We use it to reply, prepare the assessment you asked for, and follow up on your request by email or WhatsApp.

Free downloads (/recursos)

Your email and, if you provide it, your name. We use it to send you the resource and, afterwards, a few emails with related tips, new-tutorial alerts and how we can help your business (for example, our assessment). You can unsubscribe at any time.

Joining the SmartCrece Community

Your name, email, WhatsApp (if provided), where you live, your business, whether you already have revenue, the task that takes most of your time, and which link or ad brought you. With your express permission, we use it to send you the community's tools and updates, and to decide which tools to build.

Website chat

What you type in the chat. Replies are generated by an artificial intelligence assistant. If you give us your name or contact details during the conversation, we save them as a request so that a person can follow up. Your browser stores a session number so the chat can remember the conversation (details in the Cookie Policy).

Calls to our numbers

When you call, an automated assistant asks for your name and the reason for your call before connecting it. We keep your phone number, what you tell the assistant (converted to text), the time, the duration and whether the call was answered. We do not record conversations. Audio is only recorded if you choose to leave a voice message after the tone.

WhatsApp and email

The messages you send us and your contact details, so we can reply.

Appointments

If you book an appointment through our online calendar: your name, your email and the time you choose, to confirm it and remind you.

Digital product purchases

Payments are processed by Stripe on its own page. We never see or store your card details. We receive your name, your email, the product and the amount, to deliver your purchase, send your receipt and give you support.

Clients of our services

Your business and billing details, and the access you give us to install and maintain your systems. We use them to provide the contracted service, bill for it and meet our tax obligations.

Website visits

We use our own analytics tool (Umami), installed on our server, which uses no cookies and does not store your IP address. We only see aggregate data: how many people visit, which pages, from which country and type of device, which site they came from, and which buttons get clicked. Visiting the site does not tell us who you are.

Business outreach

To introduce our services to businesses that may be interested, we use business contact details that are publicly listed (their website, Google Business Profile or public directories): the business name, its business email or phone, and its industry. If you get a message from us and don't want more, just reply and we won't contact you again.

3. What we don't do

  • We do not sell or rent your personal data.
  • We do not place third-party advertising pixels or cookies (such as Meta's or Google Ads') on this site.
  • We do not make automated decisions with legal or similarly significant effects on you.
  • We do not ask for sensitive data (health, religion, ethnic origin, immigration status, personal financial data). Please don't type it into the chat or the forms.

4. Who we share it with

To operate, we use providers that process data on our behalf and only to deliver their service to us. Each one receives only what it needs:

ProviderPurpose
HostingerThe server that hosts the website, the chat, our analytics and our automations.
Google (Workspace)Email, and the spreadsheets where we keep our contact records (CRM). It also serves the website's fonts.
AnthropicThe AI model that writes the chat's replies. Under its commercial terms, it does not use data sent through its API to train its models.
TwilioReceiving and connecting calls to our numbers, and your voice message if you leave one.
TelegramInternal alerts to our team when a request, call or voice message comes in.
Meta (WhatsApp)The messages you send us on WhatsApp.
Cal.comThe online calendar for booking appointments.
StripePayments for products and services.
BrevoKeeping the list of people who buy our digital products.

We may also share data when required by law (for example, a court order), to defend our rights or to prevent fraud. If the business becomes a company (for example, an LLC formed by its founder) or changes ownership, your data would pass to the new entity with the same protections described in this policy.

5. Data of our clients' customers

When we set up a system for a business (a WhatsApp assistant, a CRM, its bookkeeping), we process that business's customers' data on its behalf and following its instructions. In that case:

  • The data belongs to the business, and we export it whenever it asks, whether it stays with us or not.
  • We don't use it for our own purposes or mix it with other clients' data.
  • The business is responsible for telling its customers how it handles their data.
  • The exact terms are in our contract with each client, which prevails over this policy.

If you are a customer of one of those businesses and want to exercise your rights, please contact that business first; we will help it respond to you.

6. How long we keep it

  • Contacts and requests (CRM): while we have a relationship or an open conversation with you, or until you ask us to delete them.
  • Community and resources: until you unsubscribe.
  • Chat conversations: kept so the assistant can remember the conversation if you return; deleted when you ask.
  • Calls: the call-screening system deletes its log after 60 days; one history line remains in the CRM (number, date, reason and outcome). Voice message audio is deleted from Twilio as soon as it reaches us.
  • Billing and payments: as long as U.S. tax law requires.

7. How we protect it

The website and all forms are encrypted (HTTPS). The server is private with restricted access; service keys are not in the website's code; internal areas are password-protected; and only people who need the data to help you can access it.

No system is 100% secure. If an incident ever affected your personal data, we would notify you as required by Texas law.

8. Your rights

You can ask us, free of charge, to:

  • Know what data we have about you and why.
  • Correct anything that is wrong.
  • Delete your data.
  • Get a copy of your data in an easy-to-use format.
  • Stop receiving our emails or messages.

Write to hola@smartcrece.com with the subject "Privacy." To protect your data, we may ask you to confirm it's you (for example, by writing from the same email address). We reply within 45 days.

Some data we are legally required to keep (for example, invoices); if so, we will explain why. If you disagree with our answer, you can ask us to review it by replying to the same email. If you live in Texas and are still not satisfied, you may contact the Texas Attorney General.

9. Emails, WhatsApp and opting out

We only send you messages related to what you asked for, to your relationship with us or, for businesses, an introduction to our services. To stop receiving them, reply "unsubscribe" (or "baja") to any email or message, or write to hola@smartcrece.com. We will remove you from the list and won't contact you again for marketing.

10. Minors

Our services are for businesses and adults. We do not knowingly collect data from anyone under 18. If you believe a minor has given us their data, write to us and we will delete it.

11. If you live outside the U.S.

SmartCrece operates from the United States, and your data is processed there and wherever our providers operate. If you live in the European Union, the United Kingdom or another country with its own data protection law, you also have the rights that law gives you, and you can exercise them the same way, by writing to hola@smartcrece.com. We process your data because you ask us to (your request or your contract), because you give us your consent (the community and resources), or based on our legitimate interest in serving you and presenting our business, and you can always object.

12. Changes and contact

If we change this policy, we will post the new version here with its date. If the change is significant, we will announce it on the website or by email to anyone with an active relationship with us.
