Terms and Conditions

1. Who we are

SmartCrece is a business of Yerandi Reyes Fajardo, its founder, who runs it as an individual (sole proprietor) from Houston, Texas, United States. In these terms, "SmartCrece," "we," "us" and "our" refer to him and to this business, and "you" refers to anyone who uses the website or our services.

2. Acceptance

By using smartcrece.com, submitting a form, writing in the chat, joining the community or buying a product, you accept these terms. If you don't agree, please don't use the website. You must be of legal age to contract with us.

3. Contracted services

Our services (AI customer service, CRM, bookkeeping, websites, automations, assessments and custom projects) are contracted through a written proposal or contract. That document sets the scope, price, timelines, guarantee and cancellation terms, and prevails over these terms if there is any difference.

• Prices. Prices on the website are indicative and may change. The one that applies is the one in your accepted proposal.
• Guarantee. The 60-day results guarantee applies under the conditions written in your contract.
• Cancellation. There is no forced commitment: you can cancel with 30 days' notice, as stated in the contract.
• What's yours is yours. Your data, your domain, your WhatsApp number and your Google Business Profile belong to you, and we always hand them over. The system we set up (automations, assistant, dashboards) belongs to SmartCrece and you pay to use it; the terms for keeping it if you leave are in the contract.
• Your part. For the service to work, we need you to give us information and access on time, that it be accurate, and that you have the right to use it.

4. Digital products

Digital products (such as the Financial Control Panel) are a one-time payment through Stripe and are downloaded immediately.

• License. You may use it in your business and on your own devices. You may not resell it, share it publicly or redistribute it.
• Refunds. Because you receive the file instantly, there are no refunds for a change of mind. But if you cannot download or open it and we can't fix it, we will refund you if you ask within 14 days of purchase by writing to hola@smartcrece.com.
• Your data. The Panel runs on your computer: what you enter in it never reaches us.

5. Free resources and community

The community's resources, tools and live sessions are free and for your personal or business use. You may not resell them or present them as your own. We ask for respect in the community: we may remove anyone who insults others, spams, or uses the space to sell without permission. We may change or stop offering any free resource when we see fit.

6. Information, not advice

What we publish on the website, in the chat, in videos, in live sessions and in our tools is general information. It is not legal, tax, accounting or financial advice. Before making tax, contract or investment decisions, consult a professional (for example, a CPA or an attorney).

The cases and results we show are real, but every business is different: they are not a promise that you will achieve the same.

7. AI chat and calls

The website chat and our call assistant use artificial intelligence. They answer instantly, but they can make mistakes. What the assistant says is not an offer or a commitment: what counts are our written proposals. If something matters, confirm it with us.

8. Acceptable use

You may not:

• Try to access private areas, systems or accounts that aren't yours.
• Send viruses, malicious code or a volume of requests that harms the service.
• Scrape the website at scale with bots, or use the chat or forms for spam.
• Give us false data or someone else's data without their permission.
• Use the website for anything illegal.

9. Intellectual property

The SmartCrece name and logo, and the text, designs, videos, tools and code of this website belong to SmartCrece or its licensors. You may share links to our content, but you may not copy it or use it commercially without written permission.

10. Third-party services and links

For some things we use other companies' services (for example, Stripe for payments, WhatsApp for messages or Cal.com for appointments), and we link to social networks. Those services have their own terms and we are not responsible for them.

11. Limitation of liability

The website, the chat and the free resources are provided "as is," without warranties beyond those required by law. To the extent permitted by law, SmartCrece is not liable for indirect damages, lost profits or data loss arising from the use of the website or the free resources. In any case, our total liability to you will not exceed what you paid us in the 12 months before the event giving rise to it (or 100 U.S. dollars if you have paid us nothing). Nothing here limits any rights the law gives you that cannot be waived.

12. Governing law and disputes

These terms are governed by the laws of the State of Texas and applicable U.S. federal law. If a problem arises, please write to us first at hola@smartcrece.com: we commit to trying to resolve it in good faith within 30 days. If it is not resolved, any claim will be brought before the courts of Harris County, Texas.

If any part of these terms is found invalid, the rest remains in effect. These terms are available in Spanish and English; if there is any discrepancy, the Spanish version prevails.

13. Changes and contact

We may update these terms. We will post the new version here with its date; changes do not affect anything already agreed in writing.
